On this week’s episode of Drop Dead Diva, Jane wakes up to find her guardian Angel Paul sleeping right next her, and in the nude no less. But Paul doesn’t look shy. While he might not have a place to stay, Jane isn’t exactly thrilled to have him at her place. Looks like the hunky guardian will be keeping her on her toes.
Walking in the kitchen, Jane finds Stacy sitting there, looking exhausted from working so hard at the Pakery. Stacy is finding that owning a business is hard work, so she’s decided to take a day off to talk to a top business woman.
Kim is in her office, when a woman named Amy, from her prenatal yoga class walks in. Amy does not want the baby she is carrying because it’s not hers. She’s a surrogate mother. Turns out she responded to an ad from a lawyer named Nina Lewis. Nina took care of everyone, including the checks. Amy tells Kim she has two kids, and only agreed to surrogacy, in order to help a couple and make some extra money.
Jane goes in to meet the new client Kim assigned her. Her client happens to be a heartbroken woman, who wants to sue her ex-fiancé for the humiliation he caused her. Two days before their wedding he broke off their engagement, and found out he was dating his dental hygienist. Jane is really upset about this jilted bride case. She yells at Kim, asking if it’s all a joke. Kim assures her Miss Bendall is a real case. She also tells Jane, she had nothing to do with assigning her the case. Kim’s new partner and Jane’s new boss Owen assigned the case. Pam is a court stenographer, and when Owen heard about what happen, he thought it make a good case. Owen tells Jane, Pam deserves justice; she needs to make it right.
Kim goes to talk to Miss Lewis, where she asks her if she can ask a woman to carry a baby and not live up to her obligations. But Lewis tells her things change since it’s a risk you take in these types of arrangements. She tells Kim if she really wants to go to court she’s ready.
At home, Jane finds Stacy where she tells her the news about Owen being her new boss. Jane thinks it might be a good idea because now he’ll have to talk to her, and give her a second chance. But Stacy asks whether she really wants a second chance, hinting about Grayson. Jane feels confused and doesn’t think Grayson is an option.
Back in court, the opposing lawyer states that California civil court section 43.5, which prohibits lawsuits for breach of promise to marry. Jane says it’s only on the book, because no one has the guts to challenge it. The judge tells her if she really wants a trial she will not overrule the statute, but will allow the portion of Jane’s complaint that allows economic damages to proceed, but will limit the complaint of quantifiable financial damages. Jane says the pain of a broken heart has to be worth something, judge says maybe, but not in her court. Grayson comes in, and he asks Teri what’s going on. He is surprise when he learns Owen is now a partner.
Stacy meets with the business woman, but the meeting doesn’t go as planned. Stacy acts unprofessional, especially when she admits she has no business plan. The lady advises her to grow up or give up. And that she has no business being in business. Stacy just stays with her mouth opened.
Amy is on the stand recounting what happen, when Miss Lewis asks Amy if they ever signed a contract. The judge says without a written agreement they cannot prove anything. Kim wants to know who the parents are but the lawyer Nina Lewis says she cannot disclose the information.
Stacy is feeding Paul, noting that he has a hardy appetite. When Jane finds out there’s no more eggs because he’s eaten them all, she gets upset. She tells Paul he has overstayed his welcome. Paul asks if he can shower before he goes. He then comes out naked and wet, which isn’t helping him win Jane over. But Stacy is all smiles. Paul definitely brings some needed distraction to all the tension.
Upset about Owen being partner, Grayson confronts Kim about hiring him. Kim tells him maybe next time you shouldn’t stick your tongue where it doesn’t belong. She says it’s the best interest of the firm. Now she wants Grayson to help with her case. They need to find the biological parents for the surrogate’s baby.
Grayson has a job for Stacy to act. He wants her to get into a lawyer’s office to copy some info from the computer. With Grayson giving instructions on the phone, Stacy goes to take a photo of the computer screen. Once she’s done, Grayson tells her to leave right away. Jane then comes in and catches Grayson smiling. He tells her what Stacy is doing, and that she is working for shoes. While talking he is eating a cookie and crumbs fall on his jacket. Jane laughs and wipes the crumbs off. In walks Owen and sees the two. He gets upset and tells them that if they want to kiss right here to go ahead. This makes Jane and Grayson uncomfortable.
Kim meets up with the couple and the surrogate mom. They really want the baby, but couldn’t afford the adoption fees. Grayson tells them they are filing a lawsuit for walking away for their responsibilities. They explain that the husband lost his job, and they had taken a second mortgage to pay the fees. We find out the lawyer is charging $150.000, but the surrogate is only getting $35,000. Mrs. Newsome had met with the attorney for the first time 6 months ago, meaning the surrogate was already 3 months pregnant, that’s why Mrs. Newsome used the word “Adoption” instead of “Surrogacy”. The real parents are anonymous donors. It turns out Nina found a way to cook the books. She sold the unborn baby. Since it’s illegal to arrange for women to get pregnant in order to make money off of an adoption, Nina fraudulently filed an Intended parent agreement just to make it look legit. Grayson decides to look 6 months back to find the paperwork they need to prove their case.
Jane wants to amend her claim to include breach of promise to marry because John proposed and Pam accepted in Hawaii. Judge agrees to apply the Hawaiian law in the case. Now all Jane has to do is her closing argument.
Back at the house, Paul shows up with various items he used during his stay. He also gives Jane oranges since he figured eggs would break. He washed her silk pillowcases, which she tells him you can’t do, so he gives her polyester because it is more durable. About to leave, Paul tells Jane he won’t bother her in her place again, but Jane has a change of heart and asks him to stay and crash on her couch. Paul is really a kid at heart. He even asks to borrow $20 bucks and runs off like a happy kid.
Kim is visiting the surrogate, while the couple is there holding the baby. But child services come to claim the baby because of the fraud done. The couple is devastated as child services are putting him in daycare and then the foster system. Kim goes to talk to the Judge, where she finds out they are conducting a review and are arranging for the arrest of Nina Lewis. However, the child has to remain in state custody.
Owen tells Jane she is not closing, Pam is. Owen feels she needs to be heard.
Grayson and Kim go to the hospital with the lady from the state. It turns out that under California law the hospital is required to list the surrogate mother as the birth mother, where she now has the power to decide on the well-being of the baby. Since Nina’s assets were frozen Amy gets restitution. Amy gives the baby to the adoptive parents, she just wants the money she was promised and the rest will go to the baby’s future. It’s a win-win situation for everyone.
After her emotional statement, Pam closes her case. She doesn’t want anything else from John and leaves the court.
Stacy shows Jane the money the business woman offered her to buy the Pakery. Stacy decides to sell the Pakery with Jane’s support. She feels happy and free.
Jane talks to Owen, but he doesn’t really want to talk to her, he is still hurt. He tells her he was happy before he met her and now he just feels lonely all the time. Jane wants to be back in his life. She wants to marry him, and thinks they could be back to the way they were, but Owen doesn’t believe they will ever be the way they were. He walks out of the room. Jane accepts the truth. She takes off the engagement ring and leaves it on Owen’s desk.
