Jane is doing her best to avoid her ex on this week’s episode of Drop Dead Diva. She has even timed her arrival at the office so there’s no chance of her bumping into Owen. Of course, it would not be a classic Paul moment, if Jane did not rush out the door with Paul on toll; albeit a Paul wearing only his underwear. He even tells her he’ll dress in the car. As we said before, he’s definitely keeping Jane on her toes!
But even with all the running around, Jane can’t quite avoid seeing Owen. He eventually catches up with her, and makes mention of the fact that she’s been avoiding him. He also tells her that Kim is unsure whether he and Jane can work together. Even though Jane disagrees, she doesn’t say it convincingly. Owen then tells her he is now her personal co-counsel on the Jenson Pro Bono. This leaves Jane a bit stunned, but she plays it off with a smile on her face.
The pro bono case happens to be about a high school student named Nick, who is accused of cheating on his SAT’s. Jane explains how if your score increases more than 350 it triggers automatic investigation. He says he studied every moment, except when he was on track. His first test was 1650 and his second was 2050. Owen is in disbelief. Nick explains that he needed an 1800 for college. Jane suggests Nick take the test again, but he says the next test date is a month away and he needs to send his score in to Tufts before the due date. At the meeting, Jane cuts Owen off and tells Nick they will file arbitration and get right on it. When he leaves, Owen scolds her, and tells her not to ever cut him off. She just wanted to give the kid hope, and he was being negative. Owen tells her you have to watch out for the ones that look like they won’t cheat. He isn’t just talking about the case.
Kim and Grayson are meeting with their clients, the Morts. It so happens that their dog Billy is accused of raping and impregnation. The neighbors Charlie and Pesha accuse Billy of defiling their dog, Stella. We find out Charles loves to sue.
Principle Daly attests to Nick’s improvement in the SAT scores because of her school’s amazing Prep course. She says he lacked focus because he was training for track. It’s now up to the arbitrator to decide whether they will accept the test scores.
Elsewhere, Paul is spying and taking pictures of Stacy as she is having coffee with a woman named Leslie.
Grayson asks Kim is spying on her assistant. She is confused as to why the assistant is still there even after she fired her. Grayson tells her, Owen re-hired her since Kim cannot make her assistant do personal errands, according to the HR. manual. She’s surprised Grayson actually read the HR. Manual. Grayson is distracted with Jane, when Kim tells him to focus. He says attractive nuisance. She asks if he’s calling Jane that, and he says yes, but quickly says no. He explains that it’s a form of attractive nuisance in which you are attracted to something dangerous, just like a kid to a swimming pool. He believes they can use that as an argument, saying Billy is not responsible for his attractions, since Stella was a dog in heat.
Paul comes in and shows Jane pictures of Stacy drinking Chai latte with agave with the other woman. She believes she’s been too obsessed with herself; she hasn’t had time for Stacy. So she thinks Stacy got herself a new best friend. Jane asks Teri to send flowers to Stacy, not before Teri wonders where her flowers are since she’s a wonderful friend and an assistant. Jane agrees, and tells her to get flowers for herself too. Teri, funny that she is, adds she doesn’t really want flowers, she wants chocolate. Jane says okay and runs off to meet with the Jensons. Owen says he spoke to the arbitrator, who sided with the testing service. They will require the three months for investigation. Jane doesn’t want to give up, and recommends they get an appeal.
However, they now have something else on their plate when Nick fails a drug test. Even though he denies it, Owen says they found amphetamines. Since the school has a zero tolerance policy, Nick has been expelled. And if things aren’t worse, Nick’s mother gets arrested for the criminal sale of a control substance.
Jane and Owen go to the correctional facility to talk with Mrs. Jenson and explain what the D.A. believes. They think she gave her son drugs, which constitutes a sale. The test revealed his urine contained Adderall, which she has been prescribed by her physician for ADHD. The DA is aware of this since they spoke to her insurance carrier. Owen tells her Adderall is a known academic steroid, and they think she gave it to Nick. Jane asks if it’s possible Nick could have taken it himself.
Back at court, the judge doesn’t agree with the attractive nuisance argument, so Grayson and Kim’s case moves on to damages.
Nick admits he took Adderall because he heard about the “smart” benefits through a buddy in his SAT’s prep class. He says he didn’t take them to get high nor does he know where he got them from. He definitely did not get them from his mom. But he does show Owen and Jane a website, and what he did to get them.
Jane has Paul and Stacy pretend they are interested in the school, so they can find out who is selling the drugs. She then thanks Stacy, and apologizes for not being there for her since she knows Stacy isn’t telling her something. But Stacy is not ready to have that conversation.
At the school, Paul pretends he’s the kid and Stacy is married to an old guy. She asks Principal Daly weird questions then gets the principle to show her the science lab. This leaves Paul free to plant the bugging device by the locker rooms. Jane is in her office monitoring the camera when Owen walks in and sits down. She tries to do small talk, but he tells her he is trying to learn the firm’s operating procedure. Jane catches the hint. This is where things get interesting. She catches the janitor putting the envelope in the lockers. This helps prove Nick didn’t get the drugs from his mother. Owen wants to use the footage for his advantage. Jane wants Nick re-admitted into school.
Grayson visits Stacy to tell her he is in love with Jane. Stacy wants Grayson to admit it to Jane, but he says he has tried. She tells him that he should let Jane picture a life with him. Needing to hear that, he thanks Stacy for her advice.
Jane and Owen go back to the school and show the principal the footage of the Janitor putting the drugs in the locker. But she refuses to re-admit Nick because of the zero tolerance. Owen then threatens to go to the evening news and expose the school for selling drugs to rich kids. The principal doesn’t want the bad publicity, so she allows Nick to come back.
Kim and Grayson’s case isn’t going so well. Charles insists the $250.000 dollars demand is not unreasonable since Stella comes from a line of champion breed. Kim finds that price outrageous for a Maltese. Charles insists he was going to sell her, even putting an ad asking for that same amount.
Kim asks the AKC registered judge if he thought Stella was worth that amount. He disagrees. Stella has a frizz, while pure Maltese are known for their long and silky hair. Plus he notices a tear staining, probably from distichiasis. So while the dog is high caliber, she is not a champion. Charles questions the witness on the stand and discredits him.
Grayson brings in the report on the dog. They find no medical problems but discover that CVH trust is paying the check-ups. They then find out Pesha did not want her husband to sell the dog, so she opened the backyard and let the dog in heat get pregnant. And since she’s co-owner, she gets to keep the dog.
Stacy walk’s into Jane’s office, where Jane tells her she supports her. She thinks Stacy is a lesbian. But it couldn’t be farther from the truth. Stacy is actually going to freeze her eggs because she wants to be a mom someday. We also find out that Leslie, the woman at the coffee shop, is simply Stacy’s friend from yoga.
Jane and Own find out Principal Daly was trying to make the school look good so she was selling the drugs. The testing board does not want to consider Nick’s score, but he asks them to consider the fact that with the Prep class, most kids increased by 10%. Having done the math, they realized he knows his stuff. They decide to admit his SAT score of 1815, which is good enough to enter the college he wants. So it’s all turns out great for Nick.
Owen wants to know if Jane kissed Grayson in the moment or did she have feelings for him, but she doesn’t know how to answer. She then sees Paul in office, where he tells her that he working there for college credits. Jane is surprised to find Grayson at her house. He tries to tell her how he feels, but she stops him and tells him their kiss was just in the moment. She then tells him to leave. We can’t help feel bad for Grayson. Will Jane ever admit her feelings for him?
